This notice describes how medical information about you may be used and disclosed and how you can get access to this information.
Please review it carefully.

Provider Accessibility Notice

K-day PACE is the sole source of Medicare and Medicaid services for participants. Except in an emergency, all covered services must be provided by or arranged through K-day PACE. Enrollment in PACE means you agree to receive all your healthcare services through our program.
K-day PACE guarantees access to necessary care but does not guarantee access to a specific individual provider. 

Participant Rights and Responsibilities

 

As a participant in K-day PACE, you have important rights and protections, including:

  • The right to be treated with respect and dignity at all times.
  • The right to participate in decisions about your care.
  • The right to request and receive a copy of your health information.
  • The right to voice complaints, grievances, and appeals without fear of reprisal.
  • The right to leave the program at any time. Disenrollment from PACE is your right and may occur at any time.
     

Participants also have responsibilities, including:

  • Working with your interdisciplinary care team to develop and follow your care plan.
  • Using K-day PACE or K-day PACE–approved providers for all medical care, except in an emergency.
  • Notifying us if you move out of the service area or obtain services without prior authorization.

Grievances and Appeals

 

If you are dissatisfied with the care or services you receive at K-day PACE, you may file a grievance or appeal.

How to file a grievance:

How to file an appeal:
If we deny, reduce, or end a service you believe you need, you have the right to appeal orally or in writing.


Help is available:
You may appoint a representative to act on your behalf. To do so, please complete CMS Form-1696.

You may also contact the State Administering Agency for further assistance.

Nondiscrimination & Language Assistance (ACA §1557)

 K-day PACE complies with applicable Federal civil rights laws and does not discriminate on the basis of race, color, national origin, age, disability, sex, sexual orientation, or gender identity.

Free aids and services are available:

  • Qualified sign language interpreters
  • Written materials in accessible formats (large print, audio, electronic formats, etc.)
  • Free language services for those whose primary language is not English, including qualified interpreters and translated documents

Privacy & Personal Information Notice

 K-day PACE is committed to protecting your personal information and ensuring compliance with all applicable laws, including CMS regulations and HIPAA.


Collection of Personal Information:
We may collect personal information such as your name, date of birth, address, phone number, email address, insurance information, and health-related details as necessary to provide services under the PACE program.

Use of Information:
Your information is used exclusively for:

  • Delivering medical care, supportive services, and program benefits
  • Communicating about appointments, services, and enrollment updates
  • Responding to your inquiries and requests
  • Meeting regulatory and reporting obligations required by CMS and other government agencies
     

Sharing of Information:
We will not share, sell, or disclose your personal information to third parties for marketing purposes. Information may be shared only with:

  • Healthcare providers involved in your care
  • Authorized CMS, state Medicaid agencies, or regulatory authorities, as required by law
  • Business associates who provide essential operational services, bound by confidentiality agreements
     

Security:
We implement administrative, technical, and physical safeguards to protect your personal information. However, electronic communication such as text messaging may not always be secure, and you should use caution when sharing sensitive information via SMS.

You have the right to:

  • Request corrections to your records
  • Limit or revoke certain forms of communication
  • File a complaint if you believe your privacy rights have been violated

SMS Terms & Conditions

 By providing your mobile number and opting in, you agree to receive SMS or MMS text messages from K-day PACE, a Program of All-Inclusive Care for the Elderly (PACE), located at 303 S. Union Ave, Los Angeles, CA 90057. These messages may include information related to your care, appointment reminders, enrollment updates, health education, or other program-related communications.


Message Frequency:
Message frequency will vary depending on your enrollment status and communication needs. Standard message and data rates may apply.


Opt-In and Opt-Out:

  • To opt-in, you must provide express written consent through our enrollment forms, website, or by texting a keyword provided by our staff.
  • To opt-out at any time, you may reply STOP to any text message you receive. You will no longer receive SMS communications, though this will not affect your ability to receive care or other non-SMS forms of communication.
  • For help, reply HELP or contact us directly at the number listed below.
     

Privacy and Data Use:
Your privacy is important to us. We will not sell, rent, or share your mobile phone number or personal information with third parties for marketing purposes. Text message content may include protected health information (PHI) only when necessary and in compliance with the Health Insurance Portability and Accountability Act (HIPAA). All communications are safeguarded to the extent possible, but please be aware that text messages may not be fully secure.


Eligibility:
You must be 18 years or older and the authorized user of the mobile number provided to enroll in our SMS communication service.


Changes to Terms:
K-day PACE reserves the right to update these SMS Terms & Conditions at any time. Updated terms will be posted on our website and available upon request.

Changes to This Notice

We reserve the right to change this notice. Any changes will apply to all PHI we maintain and will be posted on our website with an updated effective date.
